Overview

Following the Federal Court decision in Santos NA Barossa Pty Ltd v Tipakalippa [2022] FCAFC 193, NOPSEMA has updated its ‘Environment Plan decision making guideline’ to clarify how the appeal decision will be applied to NOPSEMA’s decision making on whether the consultation requirements of Offshore Petroleum and Greenhouse Gas Storage (Environment) Regulations 2009 have been met.

This guideline will be published for immediate use, noting that further considerations may arise as assessments are undertaken and revisions may be required. The guideline will be open for feedback for three months and updated based on feedback.

Interested stakeholders are encouraged to review the guideline and provide feedback by 15 March 2023.

The updated guideline reflects the recently published ‘Consultation in the course of preparing an Environment Plan guideline’, which is also available for feedback. Stakeholders are also encouraged to review and provide feedback on that guideline if interested.
